We have a property where residents pay for natural gas heating calculated through a square footage allocation RUB. We are considering replacement of the aging heating equipment with electric heat pumps which would be added to the residents direct electric meter. We would like to send notification to the residents that in exchange for removing the RUB, they will now be responsible for heating with thier electric billing (which is direct metered).
Do others think this constitutes a material breach of lease, thus triggering the required notification to the tenant of the option to provide notice to vacate?
Also, I would love to hear from anyone who has gone through any type of RUB > Direct Meter conversion for thoughts and ideas on how you accomplished this in your communities
