I would recommend that that Association discuss the situation with their legal counsel. It sounds like there are provisions in the governing documents and/or rules and regulations which govern the leasing of units. This is a common provision and one that might need to be revisited. Revising the governing documents and/or rules and regulations vary from state to state so I couldn't be more specific than this. It is a great question you are asking and one that sounds like needs to be looked at again.

In addition, simply waivering from given policy might present other complications and again guidance to protect the management company and board is needed.

Ronald; the 20% restriction is more than likely contained in the Association's Declaration. If so the only way the Board can waive the provision is to have the Declaration amended by the membership (usually 2/3 to 3/4 requirement). The fewer the renters the better in regards to lenders.
